Patentees 2023

In 2023, approximately 27,500 patents were granted by the Canadian Patent Office, the most since I’ve been tracking patent stats, and up substantially from a slow year in 2022 when only 18,125 were granted. Boeing was the top recipient of patents in Canada in 2023. The other top recipients were Halliburton Energy Services, Huawei Technologies, 10353744 Canada Ltd. and Qualcomm. See more for the top 20. National Day for Truth and Reconciliation

In recognition of the National Day for Truth and Reconciliation on Saturday September 30th, the Federal Court will only hear urgent motions on Monday October 2. The court issued a Notice to the Parties and the Profession noting that, “due to the current wording of the amendments to the Interpretation Act and the definition of holiday in section 2 of the Federal Court Rules, the Federal Court Registry will still be open for filing on Monday, October 2, 2023, via drop-box and E-filing only” and “Litigants are reminded to include Monday, October 2, 2023, in their computation of time.” October 2nd is generally considered a holiday at CIPO.

CIPO Fee Increases

Amendments to the Patent Rules, Trademark Regulations, Industrial Design Regulations and Copyright Regulations were registered on June 1st incorporating fee increases of about 25% as well as expanding the definition of ‘small entity’. The amendments appear to be generally inline with the versions published for consultation earlier this year. Most of the amendments come into force on January 1, 2024. Appointments

Dr. Gerald Heckman, a professor at the University of Manitoba’s Faculty of Law in Winnipeg, was appointed a Judge of the Federal Court of Appeal. John C. Cotter, Partner at Osler, Hoskin & Harcourt LLP in Toronto, was appointed an Associate Judge of the Federal Court. Judicial appointments were also made today to the Tax Court, Ontario courts, Alberta courts, Quebec courts and the BC courts. Continue reading Appointments
