In a series of releases on Sunday evening, CIPO stated that, “there are no extensions in place for time limits and deadlines related to acquiring or maintaining intellectual property (IP) rights with CIPO” and directs people to online solutions. A notice on the CIPO website today, says that the regional offices in Toronto, Vancouver, Edmonton and Montreal are not receiving CIPO correspondence until further notice. TM Practice Notices
CIPO posted new and amended practice notices for several aspects of trademark procedures:
- extensions of time in examination – the office will no longer grant extensions of time unless exceptional circumstances are shown;
- filing of divisional applications without a specific e-service;
- transitional provisions for Nice classifications;
- renewal of applications that do not have Nice classifications; and
- temporarily appointing a trademark agent for dealing with Nice classifications.
Fee Increase
CIPO has announced that Industrial Design fees will increase by 2.2% as of January 1, 2020 pursuant to the Service Fees Act. The announcement notes, that “As a result, the amounts shown in the Tariff of Fees of the Industrial Design Regulations may not be up-to-date.” Continue reading Fee Increase

In support of the upcoming changes to the Trademark Act, CIPO is taking some online services offline for patents, copyright, industrial designs from Thursday, June 13, 2019, at 4 p.m. EDT to Friday, June 14, 2019, at 7 a.m. EDT. Patent Consultation
CIPO has announced a consultation on changes to the Manual of Patent Office Practice (MOPOP) relating to administrative topics as part of changes to the Patent Act and Rules. Topics covered including filing requirements, divisionals, priority, transfers/assignments, corrections, abandonment/reinstatement, and due care. The consultation is open until May 27, 2019.
Downtime
CIPO has announced that “all applications will be inaccessible” from 3pm November 1st to 6am on November 5th. This relates to the upgrades needed to support the Industrial Design Act and Regulations amendments coming into force on November 5th.
Patent Pending
My recent article on patent pendency was published this week on Slaw. For patents granted by the Canadian Patent Office in the first half of 2018, the duration a patent application was pending ranged from less than 6 months to over 18 years.
3,000,000
CIPO announced today that it has allocated patent application number 3,000,000. This is the one-millionth ‘New Act’ patent application.
Top Patentees 2016
In 2016, approximately 26,400 patents were granted by the Canadian Patent Office, up significantly from the approximately 21,900 granted in 2015. BlackBerry was again the top recipient of patents, with over twice the patents obtained as any other applicant.
