"Jus Dose Inc. and Jus Loop Inc. are direct competitors in a niche product that they have been marketing for several years: the "shot" - or single dose - of a drink whose base product is turmeric. ... The dispute between the parties arises entirely from Loop Inc.'s creation of a new brand image — or "rebranding" — for its single dose. Dose Inc. considers that the packaging of Loop Inc.'s single dose is so similar to its own that it amounts to unfair competition. ... Since Dose Inc.'s application for an interim interlocutory injunction is not urgent, it will be dismissed. ... As Loop Inc. has not yet widely marketed its product with the new packaging and Dose Inc. has not put forward any evidence tending to demonstrate confusion, the Tribunal is not convinced that Dose Inc.'s allegations demonstrate a strong prima facie case. ... At best, the consequences of the marketing of Loop Inc.'s single doses on Dose Inc.'s turnover, its goodwill or its reputation are hypothetical. For these reasons, the court dismisses the request for an interim interlocutory injunction of Jus Dose inc." (Based on a translation)
