The first Certificate of Supplementary Protection has issued, providing two years of protection. Twelve applications for certificates of supplementary protection have been filed since the regulations came into force in September 2017.
Certificates of Supplementary Protection (link) allow for up to two years of supplementary patent term relating to regulatory approval delays for pharmaceutical products (see Certificate of Supplementary Protection Regulations).
The patent that was the subject of the first CSP, CA2,463,476 was granted in September 2017 to Wyeth Holdings and is entitled, “Novel Immunogenic Compositions For the Prevention and Treatment of Meningococcal Disease”.
