The Competition Bureau has published draft “Intellectual Property Enforcement Guidelines” for public comment. The guidelines will describe the Bureau’s position on issues such as patent settlements, including under the PM(NOC) Regulations, standard essential patents, and patent assertion entities.
The Bureau seeks comments on the draft guidelines (link) until August 10, 2015. The guidelines are updated from the preliminary version published in September 2014 (see earlier post).
The guidelines include several ‘hypothetical examples’, including on settlements under the PM(NOC) Regulations.
