CIPO issued a notice today that it is still reviewing comments received on its proposed guidance to patent Examiners relating to patentable subject matter. CIPO indicated that it will provide an update in October.
The Amazon.com decision of the Federal Court of Appeal was released in November 2011 and addressed the patentability of Amazon.com’s “one-click” patent application. Following the decision, the patent was granted in January 2012. In April, CIPO published proposed guidance for examiners on patentable subject matter for consultation and comments were received from the public in May. Maybe we can expect a Practice Notice next month.
